ARES TURISMO TERMS AND CONDITIONS: CANCELLATION AND BAD WEATHER

1. Cancellation Management (Standard):

• More than 72 hours before departure: Refund of 80% of the total service cost (if the full amount has already been paid). The 20% deposit paid at the time of booking is non-refundable under any circumstances, as it covers vehicle blocking costs and administrative management.
• Within 72 hours of departure: No refund (100% penalty on the total service amount), including cases of no-show.

2. Delay and No-Show Management (Departure):

• Punctuality: The start and end times of the rental or tour are fixed. In the event of a delay by the Renter, the duration of the service will be reduced proportionally. It is not possible to recover time lost in queues or request refunds or price reductions.
• Right of Reassignment: In the event of a delay exceeding 60 minutes from the agreed time without communication, Ares Turismo reserves the right to release the vehicle to third parties, retaining the full amount paid as a penalty.

3. In case of bad weather:

In the event of adverse weather conditions, we can postpone the booking free of charge (subject to availability) or refund the full cost.

Please Note: “Bad weather” refers EXCLUSIVELY to persistent rain or conditions that, at the sole discretion of the Lessor, compromise navigation safety. For Van tours, the service takes place regularly even in rain, except for official weather alerts.

Limitations: Purely “aesthetic” climatic conditions (e.g., cloudy skies, cool temperatures) do not constitute grounds for a refund or cancellation.

ART. 1 – DEFINITIONS AND SERVICES

Lessor: ARES TURISMO di Andrea Ambroggi, Via Kennedy 88, 07041 Alghero (SS). VAT No: 02788060909.

Renter: The individual using the service and assuming its risks and responsibilities. These conditions apply indiscriminately to: boat and dinghy rentals, guided boat tours, and van tours.

ART. 2 – OBLIGATIONS AND VEHICLE OPERATION

• Damage check: The Renter declares that the vehicle is intact upon delivery. Any damage found upon return is at their exclusive expense.
• Marine Protected Area: It is mandatory to respect the navigation limits and regulations of the Alghero M.P.A.

ART. 3 – SECURITY DEPOSIT AND LIABILITY FOR DAMAGES

• 1. Deposit or Security Document: Before departure, a security deposit of €200 (cash or card) is mandatory to cover common damages or, alternatively, an original identity document (see Art. 3, paragraph 3).
• 2. Exceeding Damages: Should the damage exceed the amount of the security deposit, the latter will be retained as a down payment. The Renter remains fully responsible for compensation for the entire amount of the damage.
• 3. Identification: To guarantee correct identification and return of the vehicle, the Renter has the option to leave an original identity document on deposit as an alternative to the monetary security deposit, subject to express consent.

ART. 4 – PROHIBITION OF ABANDONMENT AND RETURN

The contract is concluded exclusively with the formal return of the vehicle to Ares Turismo staff at the agreed point.

• Prohibition of Abandonment: It is strictly forbidden to leave the vehicle unattended or in places other than those established. Abandonment entails an immediate penalty of €500, in addition to the recovery of all restoration costs and loss of earnings.
• Authority Intervention: Should unjustified abandonment trigger emergency procedures (e.g., Coast Guard Search and Rescue), all costs and sanctions will be borne by the Renter.

ART. 5 – PENALTIES FOR LATE RETURN

Returning the vehicle after the established time entails automatic penalties for the lack of availability of the vehicle for the next customer:

• Up to 30 minutes: €30 | Up to 60 minutes: €60 | Over 60 minutes: €180

ART. 6 – JURISDICTION

For any legal dispute, the parties agree that the territorially competent Court shall be exclusively that of Sassari.
